These Terms of Service ("Terms") govern your access to and use of the auradata service, the auradata GitHub App and the auradata.dev website (together, the "Service"), operated by Aura Cloud Org ("auradata", "we", "us"). By creating an account, joining the beta or using the Service you agree to these Terms. If you use the Service on behalf of an organization, you represent that you have authority to bind it.
[Legal entity and governing law to be added before general availability]
1. Beta service
The Service is provided as a private beta. It may contain defects, may change without notice, and may be suspended, limited or discontinued at any time. We will give reasonable notice before ending the beta or removing your data. Beta pricing and limits are described on the Site and may change at general availability.
2. Accounts
You must provide accurate account information and keep your sign-in credentials secure. You are responsible for activity under your account and for the actions of the people you invite to your workspace.
3. Your content and data
You retain all rights to the code, configuration, credentials and data you provide to the Service ("Customer Content"). You grant us a limited license to host, copy, process and display Customer Content solely to provide and improve the Service. We will not access your warehouse data except as needed to run your jobs, or as you direct for support.
4. Your responsibilities
- You have the right to connect the repositories, warehouses and accounts you connect.
- You are responsible for the credentials you store and for rotating them when needed.
- You are responsible for the content and behavior of the dbt projects you run.
- You will comply with applicable law and with the terms of the third-party services you connect (GitHub, your warehouse provider).
5. Acceptable use
You will not:
- attempt to access data, workspaces or infrastructure that are not yours;
- interfere with or disrupt the Service, or circumvent its limits or security;
- use the Service to run malicious code, mine cryptocurrency or send unsolicited messages;
- reverse engineer the Service except where the law permits;
- resell or provide the Service to third parties without our agreement.
6. Intellectual property
The Service, including its software, design and documentation, is owned by us or our licensors and protected by intellectual property law. Except for the rights expressly granted in these Terms, no rights are granted to you. Feedback you give us may be used without obligation to you.
7. Fees
The beta is free within the limits shown on the Site. If we introduce paid plans, we will tell you the price and terms before you are charged, and beta teams keep launch pricing for the period stated on the Site.
8. Privacy
Our Privacy Policy describes how we handle personal information and is part of these Terms.
9. Disclaimer of warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE OR THAT RUNS WILL COMPLETE, AND WE MAKE NO UPTIME COMMITMENT DURING THE BETA.
10. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA OR BUSINESS, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM, OR ONE HUNDRED US DOLLARS IF YOU PAID NOTHING.
11. Indemnity
You will defend and indemnify us against claims arising from your Customer Content, your use of the Service in breach of these Terms, or your violation of law or of a third party's rights.
12. Termination
You may stop using the Service and ask us to delete your account at any time by emailing hello@auradata.dev. We may suspend or terminate your access for breach of these Terms, or when the beta ends, with notice where practical. Sections 3, 6, 9, 10 and 11 survive termination.
13. Changes to these terms
We may update these Terms. We will post the new version here with a new effective date and notify beta sign-ups of material changes before they take effect. Continued use after the effective date means you accept the new Terms.
